Has experience in the area of ??Computer Science, currently conducts research focused on: information science and information technology, investigating issues related to the Data Life Cycle, Transparency and Information Flow in Productive Chains. He worked as a professor at Faccat Faculdade de Ciências Contábeis e Administração de Tupã, where he coordinated a course of Administration with Qualification in Systems Analysis for ten years and the course of Licenciatura in Computing. He worked in the private sector as a consultant, integrator and researcher of new information technologies from 1988 to 2004.

Resumo
O Direito Autoral visa proteger os autores e suas criações e buscar a disseminação do conhecimento na sociedade da informação, porém, é muitas vezes interpretado como uma lei restritiva. Desta forma, surgem alternativas de flexibilização, padronização e utilização das obras por terceiros, as licenças Creative Commons que permitem que o autor escolha a maneira que deseja que sua obra seja propagada, tornando possível que a sociedade compartilhe e consulte obras disponíveis no ambiente digital. As licenças objetivam incentivar o compartilhamento de obras de maneira organizada, seguindo o pré-estabelecido pela lei de no 9.610, que consolida e regulariza os direitos autorais no Brasil. Neste artigo, discutiremos se as licenças Creative Commons podem ser utilizadas para substituir uma lei que encontra-se desatualizada, baseando em algumas atividades comumente realizadas pelos docentes universitários na Sociedade da Informação. A metodologia utilizada foi através de levantamento bibliográfico acerca da matéria e da proposição de lista de ações que ocorrem no ambiente educacional e quais direitos atuam sobre elas. Como conclusão, percebe-se que a lei de Direitos Autorais atual não engloba todas as necessidades do usuário, sendo as licenças capazes de atuar como alternativa de proteção aos autores e oferecer aos usuários alguns direitos, mas que não pode nem deve substituir a lei.

Abstract
The copyright aims to protect the authors and their creations, as well as communicate knowledge in the Information Society. Despite of its goals, it is perceived as hard and prohibited. Thus, flexible alternatives rise, along with standardization and use by third parts, the named Creative Commons licenses, allowing the authors to chose the rules that govern how the work is used and publicized, making possible that general society shares and makes use of available digital work. The goal for this licenses is subsidize the organized usage, under the Law 9610 guidelines, which stablishes and regulates Copyright Ownership in Brazil. This work discusses if Creative Commons licenses can be used in substitution to an old law, based in some common activities used by the faculty members within the Information Society. The methods involved a systematic review and a proposal for actions that occur in the educational environment and which rights are involved. In conclusion, the current Authorship Law does not cover the needs from the users, and the Creative Commons licenses are a support and an alternative for author’s protection and can bring a few rights, but these licenses should not be used to substitute the actual Law.
